Third-party Terms
This Third-Party Platform Compliance document – supplements our Terms of Service. It explains your responsibilities when using third-party platforms and tools for advertising, website functionality, and related services.
You – the Client – are responsible for meeting all relevant third-party terms, conditions, and policies. This document is not legal advice. Refer to each provider’s official policies for the most up-to-date requirements.
Why Data and Privacy Matter
When collecting personal information (PII), such as names or emails, you must comply with applicable privacy laws. In Australia, this includes the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). In New Zealand, the Privacy Act 2020 sets out how organizations should handle personal data. Non-compliance can lead to legal and financial consequences, as well as reputational damage. Always be transparent with users about what data you collect and how it is used.
While most of our customers are in Australia and New Zealand, you may attract visitors from other regions. If your products or services reach users outside these jurisdictions, you should seek additional legal advice to ensure compliance with overseas laws – such as the GDPR in the European Union or the CCPA in California.
Advertising-Related Third Parties
Google Ads
Google Ads lets you create and manage paid advertising campaigns.
- Prohibited Content – Ads must not promote illegal, counterfeit, or malicious materials.
- Restricted Content – Some categories (for example, financial services or healthcare) require extra steps or approvals.
- Data Collection and Usage – You must not collect personal data without permission. Comply with Australian and New Zealand laws, as well as broader data protection rules like GDPR if your audience is overseas.
- Ad Destination – Ensure landing pages are clear and honest, and that they follow Google’s guidelines.

Meta Platforms (Facebook, Instagram, WhatsApp, Messenger)
Meta Platforms offer popular places for advertising.
- Prohibited Content – Ads cannot include discrimination, misinformation, or illegal content.
- Ad Targeting – Be fair and lawful in targeting. Do not use personal data in ways that breach Meta’s rules or privacy laws.
- Data Privacy – If using Custom Audiences, ensure you have user permission where required and follow privacy regulations.
- Transparency – Ads dealing with political or social issues might need extra disclosures to meet local rules.

Non-Advertising-Related Third Parties
Google Analytics
Tracks website traffic and user actions.
- Data Collection – You should not collect personal data (like emails or phone numbers) unless you have proper consent.
- Google Signals – If enabled, you must let users know you collect cross-device data, and follow privacy laws in Australia, New Zealand, and elsewhere as needed.
- Compliance – Keep up to date with Google’s official data guidelines.

Google Search Console
Monitors your site’s performance in Google Search.

Google Tag Manager
Helps organize and control marketing or analytics tags on your website.
- Policy Compliance – All tags must follow data privacy requirements.
- Data Restrictions – Do not store private details in Tag Manager without permission.

Google reCAPTCHA
Used to reduce spam and abuse in website forms.
- Privacy Considerations – Disclose the use of reCAPTCHA in your privacy statement.
- Data Collection – reCAPTCHA checks user interactions for suspicious activity.

Google Fonts
Allows easy addition of fonts on websites.
- Usage Terms – Comply with the Google Fonts API Terms of Service.
- Privacy Implications – Loading fonts may collect some data. Disclose this to users under the laws of Australia, New Zealand, and other relevant jurisdictions.

Cloudflare Turnstile
Reduces spam and abuse on website forms.
- Privacy Policy Disclosures – Tell your users you are using Cloudflare Turnstile.
- Regulatory Compliance – Make sure you meet relevant privacy regulations if collecting any personal data.

Postmark
Provides transactional email services (e.g., form submissions, confirmations).
- Email Compliance – Follow anti-spam laws (CAN-SPAM) and local regulations (like the Privacy Act 1988 in Australia or the Privacy Act 2020 in New Zealand).
- Data Handling – Use secure, legal methods when storing or transmitting personal data.
